Some argue that arbitral interim measures can be as significant as, if not more critical than, the final arbitral award. Without these measures, a non-compliant party could potentially undermine the arbitration process entirely. This session will explore the various types of interim measures available to safeguard the integrity of the arbitration process, the jurisdiction of arbitral tribunals to order such measures, and best practices for adopted criteria to grant or deny applications for interim measures by arbitral tribunal.

This session will focus on the impact of interim measures on the cost and length of the process, and how far bifurcation of the procedure could be an answer. It will discuss also the enforceability of interim measure adopted by the arbitral tribunal, the implications of non-compliance by parties, and whether court-ordered interim measures could serve as a more effective alternative.
