    Beyond the aviation sector, with its own dynamics and disputes, the evolving space industry has expanded beyond scientific exploration to include diverse commercial activities. This panel session will explore the legal challenges and disputes that arise from the increasing commercialization of outer space. From manufacturing, launch operations, and frequency usage to issues of orbital positioning and in-orbit collisions, the complexities of modern space disputes are multifaceted.

     

    Our unique panelists, all experts in their field, will discuss how the aerospace industry manages disputes through mechanisms like cross-waivers and contractual protections. Additionally, they will examine significant cases that have shaped the industry, such as frequency disputes (e.g., Eutelsat vs. SES) and export control-related arbitration (e.g., ABS Holdings vs. KT Corporation). This will be contrasted with disputes as they are handled in the aviation sector.

     

    The discussion will highlight the unique influences of geopolitics, regulatory frameworks, and confidentiality in aviation and space-related arbitration and litigation. Attendees will gain insight into how disputes are resolved at the intersection of international law, national regulations, and commercial contracts, and learn about the broader implications for the future of space commerce and cooperation.
